Fleet managers live dangerously. No matter how large your fleet of vehicles is: the legal regulations that go hand in hand with operating a company-owned fleet remain the same.

Especially in small and medium-sized companies, the vehicle fleet is often underestimated. Too often, no directly designated position has been created for fleet management. Instead, the receptionist, secretary or support staff take over the pending tasks that vehicle management entails.

Many fleet managers, especially those who do not perform these tasks as their main activity, are not aware of the risk of owner liability that is attributed to the fleet manager.

The law is clear in this respect and leaves no room for interpretation. The legal basis for this lies in § 7 of the Road Traffic Act: "The owner of a motor vehicle or trailer is liable without fault if another person is injured or killed or a thing is damaged while operating his vehicle".
